张千帆是中国最负盛名的宪法学者之一,研究领域包括比较宪法与行政法,司法制度,中西方政治、道德与法律思想。

我们必须理解,宪法规定的党的领导是抽象和一般的,不是指治国理政日常实践中各级领导人的具体行为。任何领导人都是会犯错误的凡人,譬如某个县委书记完全可能滥用职权。宪法规定的党的领导显然不是要神化任何领导人,否则就变成了人治,就抵触了宪法第五条规定的法治和依法治国。这些问题早在八十年代就得到清理并达成共识,现在不应该再成为问题。

因此,问题不在于党的领导,而在于如何领导。执政党需要通过宪法和法律去体现其意志,执政党的意志应该通过民主和法治程序体现出来,而不是通过各种讲话或指示。当然,执政党的行为可以通过制定党内规章加以规范,但这些法规、规章都必须符合宪法。事实上,你用宪法规定来坚持党的领导地位,这本身已表明执政党只能在宪法与合宪法律的框架内行使权力。否则,宪法没有意义的话,党的领导也就没有法律根基了。

实际上,世界上每个国家的政府都是不愿意实施宪法的,但民主国家的政府不得不实施宪法,最终是因为有选票,不实施宪法的话会得罪太多的选民,领导人当选了也会下台。但如果没有真正的选举,政府不用对公民负责,不实施宪法也没有什么后果。

如果双方都能了解对方的真实想法,共同点还是很容易找到的,因为央港博弈是一种“协调博弈”,而非零和博弈。中央的主要目标维持主权统一,香港则希望维持高度自治的空间和制度的完整性。在主权统一的基础之上,中央应该还是愿意去谈的。现在,中央可能对于香港有一些误解,好像主张港独的人越来越多;香港则觉得中央似乎越来越强硬,这样下去会对双方之间的情感和认知产生负面影响。

中国现体制可以被视为两次世界大战的国际“冰河期”形成的一块坚冰。现在冰河早已融化,世界主流文明一直处于自由民主的暖流中。记得刚打倒“四人帮”的时候,叶剑英就说过“坚冰已经打破,航道已经开通”。此言不虚,四十年改革开放其实就是暖流和坚冰的“热交换”过程。当然,摩擦还会不断发生,自由民主国家也会遇到移民、民粹、两极分化等问题的困扰,但是应该会有惊无险,社会契约即便破裂也会修复。如果今后若干年我们仍然处在一个温暖的国际大环境下,我相信世界文明暖流最终会化解每一块坚冰。

DeepMind and Google: the battle to control artificial intelligence
Hassabis thought DeepMind would be a hybrid: it would have the drive of a startup, the brains of the greatest universities, and the deep pockets of one of the world’s most valuable companies. Every element was in place to hasten the arrival of AGI and solve the causes of human misery.

Demis Hassabis was born in north London in 1976 to a Greek-Cypriot father and a Chinese-Singaporean mother. He was the eldest of three siblings. His mother worked at John Lewis, a British department store, and his father ran a toy shop. He took up chess at the age of four, after watching his father and uncle play. Within weeks he was beating the grown-ups. By 13 he was the second-best chess player in the world for his age. At eight, he taught himself to code on a basic computer.

Hassabis officially founded DeepMind on November 15th 2010. The company’s mission statement was the same then as it is now: to “solve intelligence”, and then use it to solve everything else. As Hassabis told the Singularity Summit attendees, this means translating our understanding of how the brain accomplished tasks into software that could use the same methods to teach itself.

It’s an impressive demo. But Hassabis leaves a few things out. If the virtual paddle were moved even fractionally higher, the program would fail. The skill learned by DeepMind’s program is so restricted that it cannot react even to tiny changes to the environment that a person would take in their stride – at least not without thousands more rounds of reinforcement learning. But the world has jitter like this built into it. For diagnostic intelligence, no two bodily organs are ever the same. For mechanical intelligence, no two engines can be tuned in the same way. So releasing programs perfected in virtual space into the wild is fraught with difficulty.

Pokemon Go Is Still a Thing?
In the parking lot, I spotted license plates from surrounding prefectures and one that read 仙台 (Sendai), which is a two-day drive from here at best. While the most likely explanation is that the driver of the car just happened to be in the area for a different reason and wanted to take part, the amount of dedication and pre-planning people did to arrive at the park before the 12 o'clock event start is quite impressive. I can understand young people wanting to spend their time playing a game in the park, but not entire families. There is clearly a lot more to Pokémon Go than I ever gave it credit for.

The AI That Has Nothing to Learn From Humans - The Atlantic
From all accounts, one gets the sense that an alien civilization has dropped a cryptic guidebook in our midst: a manual that’s brilliant—or at least, the parts of it we can understand.

You can see Go as a massive tree made of thousands of branches representing possible moves and countermoves. Over generations, Go players have identified certain clusters of branches that seem to work really well. And now that AlphaGo’s come along, it’s finding even better options. Still, huge swaths of the tree might yet be unexplored. As Lockhart put it, “It could be possible that a perfect God plays [AlphaGo] and crushes it. Or maybe not. Maybe it’s already there. We don't know.”

“Generally the way humans learn Go is that we have a story,” he points out. “That’s the way we communicate. It’s a very human thing.”

After all, people can identify and discuss shapes and patterns. Or we can argue with each other about the reasons a killer move won the game. Take a basic example: When teaching beginners, a Go instructor might point out an odd-looking formation of stones resembling a lion’s mouth or a tortoiseshell (among other patterns) and discuss how best to play in these situations. In theory, AlphaGo could have something akin to that knowledge: A portion of its neural network might hypothetically be “sounding an alarm,” so to speak, whenever that lion’s-mouth pattern appears on the board. But even if that were the case, AlphaGo isn’t equipped to turn this sort of knowledge into any kind of a shareable story. So far, that task is one that still falls to people.

LinkedIn founder Reid Hoffman: ‘Board games inspired my business strategy’

Settlers of Catan is part of a group of so-called “German-style board games” which reward strategy rather than luck and are less centred on themes of conflict than many US board games. Devised in 1995 by designer Klaus Teuber, it has also been reimagined as a very popular app. Set on a fictional island in Viking times, the aim is to collect and trade commodity cards (such as wool, grain and brick), before exchanging them for plastic roads and settlements to occupy the board. Points are awarded for things like having the longest road, and the first player to reach 10 points wins.

He says he prefers games to that other great standby of American males, hanging out watching sports. “People are bad about social stuff. They get uncomfortable in silence. One of the benefits of a board game is it replaces the silence, it keeps the momentum of the conversation going.”

Discussing books he has read recently, he enthuses about Nonzero by Robert Wright — “one of my favourite intellectual authors. Basically, his theory is you have cultural evolution because you have a preference for non-zero sum games.” As society evolves, there are more and more interactions where both sides come out a winner.

Generating naming languages

First off, the majority of words in Mandarin have two syllables. This gives it a very clear rhythmic quality. Secondly, the syllable structure is pretty much constant. Each syllable consists of a single consonant, a vowel or two, and then optionally either /n/ or /ŋ/ (written ng). So 'shan' is a valid Mandarin syllable, but 'stan' and 'nash' are not.

In real languages, words are built out of units called 'morphemes', which are the smallest units of language which still carry meaning. Some words are single morphemes (e.g. 'happy', 'sad', 'platypus'), and some can be divided up into smaller units (e.g. 'un-help-ful', 'rest-less', 're-consider-s'). The relationship between syllables and morphemes, both of which combine to form words, is hazy at best.

Fortunately, we're making up our language, so we can make it as simple as we like. One syllable equals one morpheme.

Despite the game’s initially chaotic impact, Hanke still insists there is an opportunity for local authorities to use Pokémon Go to light up neglected nature spots. The sad thing is we have a lot of great parks that people just don’t use because everybody just goes home and puts on the TV and shuts their front doors, he says. We want to pull people back out into public spaces. Some might even volunteer to clean up after themselves, he suggests optimistically.

The takeaway for me was just seeing people can be incredibly happy in the situation of extreme poverty and lack of development, he recalls. There’s this quiet happiness about the people that live in Burma.

“原来我的业余爱好还挺多的,比如打腰鼓,玩健身球,但接触到竞技麻将之后,你真要花很多心思琢磨技巧,而且各种玩法也是日新月异,要不停地学习补充,特别锻炼大脑,所以除此之外,只要增加一点体力活动就可以了,平衡身心健康。”

王桂英认为,国外选手们一开始接触的就是竞技麻将,所以牌风非常规范,而在国内,麻将虽然有着广泛的群众基础,但人员良莠不齐,而且不论在打牌环境,还是在规则的遵守上,都和国外有不小差距。“尤其是牌桌上要保持安静,这个对于国人来说特别难遵守,甚至就在推倒胡牌的那一瞬间内,也要交流一下,这对于别国听不懂中国话的选手来说显得不够礼貌。”王桂英说。

The original Pokémon (first released for the Game Boy in 1996) is a bildungsroman, or coming-of-age-story, disguised as a bug-collecting challenge.

It works because it captures the original game’s spirit of exploration, even if its players said goodbye to their childhood home years ago.

The way Tajiri describes his childhood in that interview alludes to the game’s bildungsroman quality, that of a child learning about the world around him by physically grappling with it. “If I put my hand in the river, I would get a crayfish. If there was a stick over a hole, it would create an air bubble and I'd find insects there,” he said. “In Japan, a lot of kids like to go out and catch beetles by putting honey on a piece of tree bark. My idea was to put a stone under a tree, because they slept during the day and like sleeping under stones. So in the morning I'd go pick up the stone and find them. Tiny discoveries like that made me excited.”

it’s still managed to turn its fans into a nation of Dr. Bugs, even if we aren’t turning over stones or baiting trees with honey. At its best, it can evoke a little wonder in the mundane world around us—or force us to realize the world we live in was never mundane in the first place.

Japan, and How I Failed to Figure it Out - Wait But Why
An extreme politeness example would occur when someone would take my credit card—they wouldn’t take it with their fingers like I’m accustomed to, they’d hold their palms out like a platter for me to put it on, returning the card to me with another hand platter. All of this I’m going to miss.

But Japan feels different. People I interacted with in Japan seemed to be intent on being honest and conscientious in their work because it was part of a cultural code of conduct. That’s just the way we do it in Japan is what it felt like to me. One piece of evidence for this is the nonexistence of tipping. In fact, when I tipped a waiter on my first day without realizing that I wasn’t supposed to, he ran after me on the street to give it back to me. Tipping, to him, seems like an insult—it suggests that he provided good service just to make a couple bucks.

Within a few days in Japan, my cynicism was replaced by trust, which made me begin to feel an obligation to the society as a whole to keep within the social code of integrity.

When the Japanese are horrified at the prospect of losing face and a foreigner doesn’t understand what it would even feel like to lose face, they don’t know what it feels like to be Japanese, so there will always be a distance between them.

For those who haven’t seen the doc, here’s the story: there are only about 100 restaurants in the world awarded three stars by the prestigious Michelin guide, and almost all of them are fancy restaurants. But one of them, Sukiyabashi Jiro, is in a Tokyo subway station and has 10 seats at a simple sushi bar.

For one, it shows that a creation game rather than a shooting game can rise to dominance. It also confirms that contrary to big-publisher wisdom, players are more interested in expressive and interesting interactions than simple graphical prowess, whose charms are fleeting.

In a medium that sprang from student endeavor and bedroom programming only to see the power inevitably shift to companies and, eventually, megacorporations, it’s again possible for the bedroom programmer to become a multimillionaire. Since Minecraft’s rise to prominence, hundreds of young players have been inspired to make their own games, either through structured learning in schools or by using free or cheap tools such as GameMaker on their own. Thanks to Minecraft’s example and the ease of self-publishing through channels such as the Apple App store, Google’s Play Store, and Steam, independent video-game studios are enjoying an unprecedented burst of success.
