Policing in parts of the UK is 'broken', says Police Federation chief | UK news | The Guardian
John Apter says stretched resources force police to ditch some crime investigations [...] “We can’t do everything – there are going to be situations where we simply can’t deliver the policing we want to deliver,” he said. “In those cases we are failing the public, but that’s not the fault of police officers on the ground, and in some cases it’s not the chief constable’s fault. “You can only slice the financial cake so many ways and you have to prioritise … The public are already suffering and they are going to suffer more and more.” Forces logged 5.5m crimes in the 12 months to March, a rise of 11% on the previous year and the highest tally for an equivalent period since 2005-06. // &! https://www.theguardian.com/commentisfree/2018/aug/12/the-guardian-view-on-legal-aid-cuts-have-caused-chaos-and-must-be-reversed - The Guardian view on legal aid: cuts have caused chaos and must be reversed

Lack of legal aid puts asylum seekers' lives at risk, charity warns | Law | The Guardian
As a result, “legal aid deserts” have emerged in different parts of the country due to a 56% drop in the number of providers offering legal aid representation for immigration and asylum cases since 2005, the charity found.

There was an even greater reduction in the number of not-for-profit providers, with only 36% remaining in 2018 compared with the number in 2005.// &! https://www.theguardian.com/law/2018/jul/19/i-feel-safe-now-how-legal-aid-protected-asylum-seeker - 'I feel safe now': how legal aid saved a gay man from deportation ‘Naveed’ fled persecution in Pakistan but his plea for UK asylum was initially rejected

https://www.theguardian.com/society/2018/jul/04/risks-to-children-the-biggest-social-justice-challenge-of-our-time - Risks to children 'the biggest social justice challenge of our time'
Children’s commissioner seeks more help for young people in vulnerable family situations [...] Government spending on early intervention services for children through local authorities has been reduced by 60% since 2010. The research says investing in these services is cost-effective compared with the expense of putting a child into care, which can be as much as £55,000 a year. Local authorities have said there is a growing crisis in children’s social care caused by increasing numbers of children being taken into care or made subject to child protection plans as a result of the failure to provide early support for families.

Underfunded justice system 'crumbling', top criminal barrister says | Law | The Guardian
[pure rational rationing (workload) decisions out of necessity - by individuals, forced upon them by Austerity decisions] Failures to disclose evidence in rape prosecutions are a sign of the “dystopian disaster” engulfing the criminal justice system that has been caused by chronic government underfunding, the head of the criminal bar has warned. Angela Rafferty QC, who represents criminal barristers in England and Wales, criticised ministers for trying to promote the justice system as “a national asset” at the time of Brexit when in reality “the fabric of the court estate [is] crumbling”. [...] The Law Society, which represents solicitors across England and Wales, has launched legal action against the Ministry of Justice for cutting fees for defence lawyers, who have to examine increasingly large volumes of material recovered from mobile phones and laptops.

Hillary Clinton's book has a clear message: don't blame me | Thomas Frank | Opinion | The Guardian
She seems to have been almost totally unprepared for the outburst of populist anger that characterized 2016, an outburst that came under half a dozen different guises: trade, outsourcing, immigration, opiates, deindustrialization, and the recent spectacle of Wall Street criminals getting bailed out. It wasn’t the issues that mattered so much as the outrage, and Donald Trump put himself in front of it. Clinton couldn’t. [...] But by and large, Clinton’s efforts to understand populism always get short-circuited, probably because taking it seriously might lead one to conclude that working people have a legitimate beef with her and the Democratic party. &! http://www.bbc.co.uk/news/world-us-canada-41244474 &! https://www.theguardian.com/us-news/2017/sep/12/hillary-clinton-supporters-memoir-book

Employment tribunal fees unlawful, Supreme Court rules - BBC News
Fees for those bringing employment tribunal claims have been ruled unlawful, and the government will now have to repay up to £32m to claimants.
The government introduced fees of up to £1,200 in 2013 to reduce the number of malicious and weak cases, but that led to a 79% reduction over three years.
Trade union Unison argued the fees prevented workers accessing justice.
The Ministry of Justice said the government would take immediate steps to stop charging and refund payments.
The Supreme Court ruled the government was acting unlawfully and unconstitutionally when it introduced the fees.

Why Justice for a Murdered 17-Year-Old Transgender Girl Is So Important
But there remains one big question: Will the case be investigated as a hate crime? Though, according to the Advocate, Josh knew that Mercedes, an aspiring cosmetologist, was a transgender woman before he killed her, the motive for the crime is still unkown. According to Rodgers, who said she isn’t familiar enough with this specific case to know whether or not it qualifies, “The federal hate crimes law explicitly includes gender identity as one of its categories, so [there] could be a way to charge the crime federally if the state murder prosecution is unsuccessful for some reason.” [...] If Mercedes’s murder is charged as a hate crime, it will be a unique case, as most of the transgender murders last year were not classified in that way, despite the fact that there seems to be a clear epidemic. Gender theorist Judith Butler told Broadly last year that men often kill transgender women as a result of feeling threatened.

Why Hillary Clinton’s ‘super-predator’ concession is such a big moment for political protest - The Washington Post
Clinton’s 1996 speech included some language about these so-called super-predators implying that they were a generation of guilt- and compassion-free sociopaths who, in the interest of society, simply had to be contained. [...] Clinton seemed audibly and visibly irritated, saying she would answer if allowed to speak and then, even more notably, “that no one had ever asked her that before.” Then, Clinton essentially moved on with her regularly scheduled fundraising program. There was no accounting, partial or full, for her 1996 position nor how she arrived at her 2016 stance on criminal justice reform. Moving on. [...] Clinton decided to offer an apology for using that “super-predator” and “brought to heel” language. In the 1990s both were part of a relatively popular but now largely discredited theory about rising youth crime. [ tough on crime was] effective tactic with white voters, because in the [US] there are a whole host of persistent stereotypes abt race & criminality.

MPs have launched an inquiry into the UK’s tax system after the government was accused of allowing Google to pay too little in a £130m deal. The House of Commons Treasury committee announced that it would examine whether a radical shakeup of corporation tax was needed, amid concern that Google has been allowed to get away with an effective rate of 3%. The inquiry is not directed at Google, but will investigate the UK’s shrinking corporate tax base more widely and whether HMRC is doing enough to tackle avoidance. It will ask whether there needs to be a radical shakeup of the system, and whether business taxation could be based on turnover rather than profits. Andrew Tyrie, chairman of the committee, said the UK’s tax law had become too elastic, allowing companies to get away legally with paying too little. Criminal record disclosure checks ruled 'unlawful' - BBC News
Two people who claimed their careers were being blighted by having to disclose their minor criminal convictions to employers have won their case at the High Court. The court ruled the criminal record checks scheme used in England and Wales was "arbitrary" and unlawful. People across the UK are forced to have their criminal record divulged when applying for certain jobs. The Home Office said it would consider whether to appeal against the decision. Lawyers for the pair had told the High Court that people were being unfairly disadvantaged throughout their lives by convictions for minor criminal offences committed years beforehand. Robert Downey Jr pardoned in California for felony drug conviction | Film | The Guardian
The governor of California pardoned Robert Downey Jr on Thursday for a nearly 20-year-old felony drug conviction that sent the Oscar-nominated actor to jail for nearly a year. Downey was among 91 people granted pardons for criminal convictions after demonstrating they had rehabilitated themselves and been out of custody for at least 10 years, Governor Jerry Brown’s office announced. The pardon does not erase records of a conviction, but it restores voting rights and is a public proclamation that the person has remained out of trouble and demonstrated “exemplary behavior”, according to materials on Brown’s website.

Gay British man avoids extradition to Dubai | Law | The Guardian
Court finds the United Arab Emirates failed to give sufficient assurances that Michael Halliday’s human rights would be respected. A gay man has avoided extradition to Dubai – where homosexuality is outlawed – after a London court ruled there was a risk he would be tortured and was unlikely to receive a fair trial on theft charges. In a strongly worded ruling, a judge at Westminster magistrates court said the United Arab Emirates had not given the court sufficient assurances that Michael Halliday’s human rights would be respected. In district judge Jeremy Coleman’s ruling, which sets a significant precedent, he said: “The trial, treatment and conditions of those accused or convicted of criminal offences in the UAE is still the subject of complaint and is often alleged to fall well below the required standards … Taking into account Mr Halliday’s own circumstances, I cannot be satisfied that he would not be at significant risk.
