Brett Kavanaugh, Donald Trump’s pick to replace Anthony Kennedy on the US Supreme Court, is a strong believer in the power of the presidency. So much so that he once wondered if the court erred in forcing former US president Richard Nixon to turn over the Watergate tapes.

Nixon was forced by a unanimous Supreme Court decision (pdf) in 1974 to turn over tape recordings from his offices that revealed he was involved in a cover-up tied to the Watergate break-in. Nixon resigned about two weeks later.

Kavanaugh might have made a different call. During a 1999 roundtable discussion with lawyers, Kavanaugh questioned whether the decision, which limited the president’s power to withhold information in a criminal trial, set the right precedent, the Associated Press (AP) reported.

“Maybe Nixon was wrongly decided—heresy though it is to say so,” Kavanaugh said during the discussion.

The AP reviewed a transcript of the roundtable that was published in a 1999 issue of the Washington Lawyer, which was submitted to the Senate Judiciary Committee along with other documents as part of the confirmation process. In the transcript, Kavanaugh said:

Nixon took away the power of the president to control information in the executive branch by holding that the courts had power and jurisdiction to order the president to disclose information in response to a subpoena sought by a subordinate executive branch official… Maybe the tension of the time led to an erroneous decision.

He reportedly reiterated that point three times during the discussion.

The remarks show how highly Kavanaugh values the authority of the executive branch, and how he might respond if Trump or another president were to find themselves in a similar position—for instance, if special counsel Robert Mueller were to subpoena Trump to testify on Russian meddling in the 2016 US election.

Air Force One is getting a patriotic new paint job.

US president Donald Trump has ordered up a new Air Force One—two of them, actually—which he plans to have painted red, white, and blue, rather than the blue-and-white color scheme that has graced the president’s plane since John F. Kennedy was on board. Trump announced the new presidential aircraft in an interview with CBS last week.

“I said, ‘I wonder if we should use the same baby blue colors?’ And we’re not,” he said. “Red, white and blue… It’s gonna be the top of the line, the top in the world.”

The aircraft is expected to be delivered in 2024, Bloomberg reported. That means Trump will only get to enjoy it if he wins a second term. If someone else wins the 2020 election, they might choose a different paint job.

Boeing is developing the two 747 jumbo jets that will serve as Air Force One. The manufacturer inked a $3.9 billion contract to build the aircraft, according to Bloomberg. The deal was informally made in February and officially announced last Tuesday.

It comes after years of contract negotiations between Boeing and the US Air Force that runs the aircraft. Trump first inserted himself into the talks shortly before taking office in January 2017.

Boeing is building a brand new 747 Air Force One for future presidents, but costs are out of control, more than $4 billion. Cancel order!

Though some have welcomed the unusually warm and cloud-free weather as school holidays begin, many others are suffering. Northern Ireland instated a ban hosepipes and sprinklers in June. A similar ban is expected to come into effect in the northwest of England on Aug. 5. The heatwave has also been blamed for fires that raged across northwest England in June.

Met Office, the UK’s national weather service, has warned that the heatwave will continue for some time. It has also issued health warnings as some parts of the country could hit 34°C (about 93°F), breaking the 2018 record of 33°C (about 91°F) on June 28.

Human-caused climate change is expected to make such heatwaves more frequent, according to the Met Office. Expect more records to be broken.

Tech industry CEOs are bullish on the future of their companies, the sector, and artificial intelligence.

But they're worried about the spread of nationalism, cybersecurity — and millennials.

Those are some of the key takeaways from a new report by KPMG. After surveying more than 1,000 CEOs from all different sectors and from around the globe, the company zeroed in on the responses of 104 from the tech industry.

Compared with their non-tech peers, tech CEOs were more optimistic about their firms' prospects. But they were equally worried about the turn away from globalization and dealing with younger customers.

Here are some of the report's key findings.

Tech CEOs are bullish about their companies' growth prospects.

Some 88% of tech CEOs surveyed by KPMG said they were confident in their growth potential for their companies over the next three years. More than half — 52%, to be precise — said they expected their companies to grow by at least 2% a year over that time period.

That's more optimistic than CEOs as a whole. Overall, 44% of CEOs said they expected their firms to grow 2% annually over the next three years.

 

 

In fact, many expect to boost their headcount significantly in coming years.

Some 44% of tech CEOs expect to increase their employee base by at least 6% over the next three years, and 2% expect to increase it by at least 11%.

Again, tech leaders were more bullish than their peers. Overall, just 37% of CEOs from all industries expect to increase their headcount by at least 6% over that time period.

Tech CEOs are optimistic about their industry too.

According to the survey, 77% of tech CEOs were confident in the growth prospects of the industry over the next three years.

Shazam could show a new side of Warner Bros.’s dark, gritty DC movie universe.

Warner Bros. dropped the first trailer for the upcoming film, due out in spring 2019, at San Diego Comic Con on Saturday.

Based on a comic book character, the movie follows foster teen Billy Batson as he’s granted super powers by an ancient wizard. By speaking the magic word, “shazam,” he morphs into a costume-clad, bulletproof adult, Captain Marvel, who has superhuman strength and other abilities. Unlike DC’s brooding heroes Batman and Superman, Batson appears to actually be enjoying his newfound powers.

The trailer invokes some the dark, gritty style director Zack Snyder set up for the DC extended universe that began with Man of Steel, now officially called the Worlds of DC. But it quickly abandons all of that to show the lighter, brighter side of being a superhero. Snyder, whose vision has defined much of the Worlds of DC thus far, doesn’t have a hand in this film. It’s directed by David Sandberg of Annabelle:Creation and stars Zachary Levi, best known for Chuck.

Since launching its DC movie universe in 2013, Warner Bros. has struggled to match the success of rival Marvel Studios, which has churned out hit after hit for a decade. Some DC movies, like Wonder Woman, were raving successes, but the majority, like Justice League, were duds. Shazam could open the DC movie-verse to new audiences.

Like Deadpool and Kick-Ass before it, it appears to be a refreshing entry into the genre that shows superhero movies don’t have to be so serious.

From 1916 to 1970, about 6 million African-Americans moved from the South to the Northeast, Midwest, and West. While more than 90% of African-Americans lived in the South in in 1910, this was true of only 53% in 1970. Referred to as the Great Migration, it is the largest internal movement of any group in American history.

Due to racism and economic inequality, the Great Migration has been largely ignored in popular American culture—until now. On Friday (July 20), the New York Times reported that television producer Shonda Rhimes is creating a show based on the Great Migration for Netflix (paywall). It is among eight programs being developed by Rhimes for the streaming giant, part of an agreement that will pay her at least $150 million.

Rhimes couldn’t have picked better source material. The show will be based on journalist Isabelle Wilkerson’s nonfiction book The Warmth of Other Suns, and adapted by playwright, actress, and MacArthur “genius” grant winner Anna Deavere Smith.

The Warmth of Other Suns is an astonishing book. Spanning the 20th century, it tells the stories of a young woman who left Mississippi for Chicago, a man who migrated from Florida to New York City, and another who went from Louisiana to Los Angeles. Along with these biographies, Wilkerson’s account is fleshed out with statistical analysis and descriptions of how the major events of the period, like World War II, impacted the migration. The book won the National Book Critics Circle Award in 2011.

Taking on this subject matter is a departure from Rhimes’ biggest hits such as Grey’s Anatomy, Scandal, and How to Get Away With Murder. That’s by design. “I’m not going to make you a second Grey’s Anatomy, Rhimes says she told Netflix (paywall) when she signed the deal.

Rhimes’ other seven Netflix shows are excitingly eclectic. One takes place in California when it was still part of Mexico; another is based on the memoirs of the former interim Reddit CEO Ellen Pao, about her time in Silicon Valley. There’s a drama about the lives of historical White House residents, a documentary about dance, and a comedy about “foul-mouthed teenage girls who are trapped at the end of the world.” Rhimes appears keen to illuminate all parts of American culture, and we will likely be the better for it.

Nothing tastes sweeter than victory.

New Jersey-based Mondelez International confirmed on Friday (July 20) that a lighter version of its iconic Swiss chocolate bar, Toblerone, would be discontinued in favor of an earlier design featuring smaller gaps between the triangular chunks. The news was first reported by trade publication The Grocer (paywall).

“We’re always reviewing our range to make sure we provide great quality Swiss chocolate in formats we know our fans love,” a Mondelez spokesperson told The Guardian on Friday. “The 150g Toblerone is no longer being manufactured and therefore availability of the bar depends on how much stock an individual retailer is carrying. But 100g and 360g size bars will still be available.”

The decision ends 20 months of culinary limbo for Toblerone fans, who were outraged when the company announced plans in late 2016 to reduce a 170g bar to 150g by increasing the spacing between the triangles. A 400g bar was also reduced to 360g.

At the time, Mondelez attributed the change to an increase in the cost of ingredients. “We carry these costs for as long as possible,” the company wrote on its Facebook page, assuring fans that the overhaul was needed to “ensure Toblerone remains on-shelf, is affordable, and retains the triangular shape.” An executive promised that the wide gaps were only “a short-term solution.”

On Friday, Mondelez denied that its reversal was a response to falling sales, telling the BBC that sales of the 150g bar actually increased after the shape was changed. The 200g replacement, set to hit shelves later this year, could cost as much as £3.09, according to The Guardian. That’s a small price to pay for justice.

Americans are actually pretty good at counting calories. According to a new survey from Morning Consult, people tend to be, on average, just 110 calories off when estimating calories for items at popular restaurants.

But for certain dishes, Americans have serious blind spots. People are way off when it comes to predicting the calories in Chinese egg rolls, for example, or taco salad. In both cases, survey respondents guessed there were half as many calories in those dishes as there actually are. Blended alcoholic drinks were also problematic: Pina coladas and daiquiris have more than twice as many calories as the typical American thinks. (I believe this is willful ignorance.)

The estimates are based on surveys of about 2,200 adults. The calories data is from the US Department of Agriculture, and based on the number of calories in that dish at the typical restaurant.

Phil Collins’ cover of the The Supremes’ “You Can’t Hurry Love” is the first song on the very first Now That’s What I Call Music!—or “Now,” as it’s popularly known—released in the UK in 1983. Yesterday (July 20), the 100th UK volume of the series was released; its first song is Calvin Harris and Dua Lipa’s electronic dance hit “One Kiss.” Listen to both tracks and you’ll see that we’ve come a very long way, baby.

Over its 35 years of existence, Now has developed into a music-industry juggernaut. Ninety-eight of the previous 99 UK releases spent time as the country’s number-one album. The compilation series has also spread to more than two dozen countries—78 versions have been released in South Africa and 66 in the United States. According to the BBC, the series has sold over 120 million records, including 3.2 million in 2017. It also does charitable work, helping countless people around the world place that song they heard one time at a wedding.

The mixtape began as a partnership between record labels EMI and Virgin Records. At the time, the “Top of the Pops” series, a compilation of covers of popular hits, was in its heyday. Now’s creators figured they would give people the real thing. By bringing together their respective catalogues, the labels were able to make an album with basically all the songs pop-lovers desired. Simon Draper, one of the co-founders of Virgin Records, says the name comes from an old poster that fellow co-founder Richard Branson purchased for him (Branson bought the poster from his future wife.)

The music on the albums tends to be lowest common denominator. As my colleague Corinne Purtill puts it, “Nothing about the ‘Now That’s What I Call Music!’ series is cool.” It’s not a good way to find undiscovered artists or musicians going against the grain, but it is an excellent way to stay abreast of songs that were broadly popular in any given year. In the US, Quartz found that Katy Perry and Britney Spears appeared most often on Now compilations.

For now, it doesn’t appear that Now is going anywhere. Although the mixtapes can be streamed, the albums continue to sell, particularly among older listeners content to let a pre-curated selection of sanitized pop wash over them. Now they have 100 versions do it with; here’s to 100 more.

The idea of looking at how animals live in a zoo is normal to us, but what if we let animals observe the way we live?

A Chinese photographer is exploring the question through photos that show a man dressed as a penguin roaming around China’s capital, Beijing.

Trunk Xu, one of China’s most renowned magazine photographers, took the photos in May as part of a global campaign by non-profit organization Greenpeace supporting the establishment of an Antarctic Ocean Sanctuary to ban fishing activities there. Twenty-five countries and regions will come to a final decision on the proposal in October.

Xu wanted the penguin to observe conflict and disharmony between nature and the artificial world, he told Quartz. Here are a selection of the 18 photos he took:

Whale watcher and artist Marina Rees teaches whale singing classes as part of a special exhibition at the Old Low Light Heritage Center in North Shields, England.

While many whales make sounds, male humpbacks are known for their song, which they produce by repeating long, complex patterns of sounds, sometimes for days on end.

In the 1970s, biologist Roger Payne recorded an album of humpback whale songs that inspired Greenpeace’s global ‘Save the Whales’ movement and ultimately led to an international ban on deep-sea whaling.
