Is the Stimulus Bill Constitutional? -- The Volokh Conspiracy
The stimulus bill may be unconstitutional because it says State legislatures have the right to accept stimulus money over the objections of their governors. But nowhere in the constitution is congress given the power to alter state constitutions.
